Open Flight World

These terms apply when you use Open Flight World (the website at openflightworld.com and the flight simulator at openflightworld.com/fly/) and when you buy anything in it. Please read them; they are written to be understood. By using the service, or by ticking the box when you create an account, you accept them.

In these terms, "I" and "me" mean the operator of Open Flight World, and "you" means the person using it.

Who runs Open Flight World

Open Flight World is operated by a duly incorporated company. Its contact address is [email protected], and its full identification details are provided on legitimate request to that address. It is also the way to reach me about anything in these terms, as is the contact form.

The service

Open Flight World is a flight simulator that runs in a web browser. It shows the planet in 3D, real air and sea traffic, live weather and a fleet of aircraft that you can fly with a keyboard, a mouse or a gamepad.

It needs a recent browser with WebGL and a reasonably recent computer. Phones and tablets run a lighter version. I cannot guarantee that it runs on every device, so please try the free tier on yours before buying anything.

The free tier

The Cessna 172 and Hong Kong International Airport (VHHH) are free to fly, with no time limit and no account. Everything else in the simulator comes with them; the paid options add aircraft and airports.

Your account

You need an account to buy. You sign in with your e-mail address and a code or link that I send to it; there is no password. Keep access to your e-mail secure: whoever can read it can sign in to your account.

To create an account or to buy, you must be old enough to do so under the law of your country, or have the permission of a parent or guardian. Please give an e-mail address that is yours and that you can read. One account per person.

What you can buy

  • Unlocks. An unlock adds one aircraft or one airport to your account, with a single payment, for as long as Open Flight World is offered. You can buy one, or a pack of three. Unlocks you buy without choosing an aircraft or airport stay in your account as credits until you spend them.
  • All Access. Gives your account every aircraft and every airport while it is active. It is offered monthly, yearly, or as a single payment for life ("lifetime", which means for as long as Open Flight World is offered).

What each option includes is described on the pricing page at the time you buy.

Prices and payment

Prices are shown on the pricing page and in the checkout: in euros for visitors in the European Union and nearby countries, and in US dollars elsewhere. VAT or other sales taxes are added at checkout where they apply, according to your country. The price that applies is the one shown in the checkout before you pay.

Prices can change over time, and they can be different for different visitors while I test them. A price change never affects a payment you have already made, or a subscription period you have already paid for.

The monthly All Access plan may have a reduced price for its first month. That offer applies once, to accounts that have never had All Access.

Payments are processed by Freemius, which acts as my reseller and merchant of record: you buy from Freemius, which takes the payment, issues the invoice or receipt and collects the applicable taxes. Freemius's own terms also apply to the payment. I never see or store your card details.

All Access subscriptions

Monthly and yearly All Access subscriptions renew automatically at the end of each period, and are charged by Freemius, until you cancel them.

You can cancel at any time from your account page. When you cancel, you keep All Access until the end of the period you have already paid for, and you are not charged again. Except where the law requires otherwise, there are no partial refunds for the unused part of a period.

Anything you unlocked separately stays yours after All Access ends.

Refunds and the right of withdrawal

What you buy is digital content that is delivered at once. If you are a consumer in the European Union or the United Kingdom, you normally have 14 days to withdraw from a purchase. For digital content, that right ends when the content starts to be delivered with your express consent. In Freemius's checkout you are asked to request immediate access and to acknowledge that you lose the right of withdrawal once access starts; by doing so and paying, you agree to that.

Refunds are governed by the terms of sale of Freemius, the seller, which you accept at checkout. To ask about one, write to [email protected] with the e-mail you paid with. A refunded purchase is removed from your account.

None of this limits the rights that consumer law gives you.

Acceptable use

Please do not:

  • try to get paid content without paying for it, or to get around the limits of the free tier;
  • overload, attack or probe the servers, or access the service or its data feeds with automated tools;
  • copy, resell or redistribute the simulator, its aircraft models or the data it shows;
  • share, sell or transfer your account;
  • use the service in any way that is unlawful or that harms other people.

If an account breaks these rules, I may suspend or close it. Where the breach is not serious, I will warn you first.

Third-party data and content

The simulator shows maps, imagery, 3D buildings, terrain, airport data, weather and live traffic that come from third parties, under their own licences (listed in the legal notice and in the simulator's options). That data is shown as it comes: it can be incomplete, delayed or wrong, and it can change or stop being available.

The names of aircraft and manufacturers belong to their owners. Open Flight World is not affiliated with, or endorsed by, any of them.

Open Flight World is entertainment. It is not a certified flight training device, and nothing in it, including its weather, traffic, maps, charts or procedures, may be used for real navigation, flight planning or flight training.

Availability and changes

I work to keep Open Flight World available and to improve it, but it is provided as it is, and it may sometimes be interrupted for maintenance or because of problems outside my control. I may change, add or remove features, aircraft and airports. I will not remove content you paid for from your account while Open Flight World is offered, except when a purchase is refunded or reversed. If I stopped offering Open Flight World, the unused part of any period you have paid for would be refunded.

3-year guarantee for what you buy for life. All Access for life and unlocks are paid once and last for as long as Open Flight World is offered. I undertake to offer it for at least the 3 years following each such purchase. If I stopped within that period, I would refund the pro-rata share of the price that corresponds to the time left until the 3 years are up: for example, if I stopped at the end of the first year, I would refund two thirds of what was paid. After 3 years the guarantee is fulfilled and no refund is due on this ground.

Liability

To the extent the law allows, I am not liable for indirect or consequential losses, and my total liability for any claim related to Open Flight World is limited to the amount you paid me in the twelve months before it. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, nor your rights as a consumer.

Closing your account

You can delete your account at any time from your account page. Deleting it does not cancel an All Access subscription by itself: please cancel it first. When the account is deleted, what it owned can no longer be used.

Changes to these terms

I may update these terms, for example when the service or the law changes. The date at the top shows the latest version. If a change is important, I will say so on the site and, if you have an account, by e-mail before it applies. Changes never affect purchases already made.
